Who may adopt?
Any person.
A parent's partner.
Consent for adoption to be executed?
Consent by a parent may not be executed earlier than 36 hours after the child's birth.
Consent by a guardian can be made any time after being authorized by the court.
Consent by an agency may be made any time before or during the hearing on adoption.
Consent is irrevocable after 21 days.
Consent is revoked if the parent notifies the court within 21 days; or the parent and prospective adoptive parent agree.
Consent may also be set aside if it was obtained by fraud or duress, or if a condition permitting revocation has occurred.
Who may place a child for adoption?
The parent having legal custody.
A guardian.
An agency to which the child has been relinquished.
Advertising?
This issue is not addressed in the statutes reviewed.
Facilitators?
A parent or guardian authorized to place a minor for adoption may place the minor only with a prospective adoptive parent who has a valid favorable pre- placement evaluation or for whom a pre-placement evaluation is not required. The parent or guardian shall personally select a prospective adoptive parent.
A parent or guardian may be assisted by another person in locating a prospective adoptive parent. A prospective adoptive parent may be assisted by another person in locating a minor who is available for adoption.
Putative Father's Registry?
No. The putative father must file a claim of paternity within 20 days after notice of termination proceedings, unless a claim of paternity is pending.
Reasonable efforts are made to identify and notify the biological father.
This may include inquiries of appropriate persons.
Expenses?
Birth parent-
Medical, hospital, pharmaceutical, nursing, or other similar costs.
Counseling.
Living expenses.
Legal fees and court costs
Transportation.
Any other service or expense the court finds reasonable and necessary.
Payments for living expenses may continue for no more than 6 weeks after the birth.
Department/Agency -
An agency may charge fees for:
- Birth parent expenses;
- Counseling services;
- Legal services or court costs;
- Preparation of evaluations;
- Transportation services.
